A Federal High Court in Abuja has dismissed a N1 billion lawsuit filed by Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB), against the Nigerian government and the Department of State Services (DSS).
Kanu’s suit, marked FHC/CS/1633/2023, alleged that the DSS and its Director General violated his right to fair hearing by preventing his lawyers from having unrestricted access to him during his detention, thereby hindering the preparation of his defense in his ongoing criminal trial.
The judgment, delivered on Monday by Justice James Omotosho, addressed the alleged violations of Kanu’s fundamental rights while in detention. However, Justice Omotosho ruled that Kanu did not provide sufficient evidence to support his claims.
Kanu’s legal team contended that the DSS obstructed access to legal counsel and illegally monitored their conversations. Justice Omotosho concluded that these allegations were not substantiated by credible evidence.
